IDEA RE-AUTHORIZATION: Attorney Fee Caps will Leave Our Children Behind

Congress is poised to leave millions of children behind, and the hardest hit will be those children least able to take the hit: children with disabilities from low-income households.

The Individuals with Disabilities Education Act (IDEA), the nation's special education law, is currently before Congress for reauthorization. Of the many proposed changes to IDEA, perhaps the most devastating is the proposal to limit the amount of reimbursement a successful parent litigant can recover. The House bill (H.R.1350) would allow state governors to establish limits on recoverable fees.
